California Gambling Laws

The California State Constitution permits the following forms of gambling regulated by the state or the state’s Native American tribes:

  • Tribal Casinos aka “Vegas-Style Gambling”
    • Allowed: Slot Machines, Blackjack, Baccarat, Pai Gow, Various Forms of Poker, California Craps or Roulette (uses cards instead of dice).
    • Not Allowed: Sports Betting, Percentage and banking games played with cards or dice. e.g. Traditional Roulette, Craps, Faro, Monte, Roulette, Lansquenet, Rouge et Noir, Rondo, Ran, Fantan, Seven-and-a-Half, Twenty-One, Hokey Pokey
  • Card Rooms
  • Parimutuel Horse Race Wagering: Form gambling in which players’ bets are pooled so that they are playing against one another instead of against the “house.”
  • Bingo
  • State-run lottery

Additional Games Not Allowed Anywhere: Dealing, playing, or conducting, games of faro, monte, roulette, lansquenet, rouge et noir, rondo, tan, fantan, seven-and-a-half, twenty-one, hokey pokey, or any banking or percentage game played with cards or dice.

California Minimum Gambling Age

The minimum gambling age in California is 18.

Minimum gambling ages are 21 years old for casinos that serve alcohol which is most, 18 years at tribal casinos without alcohol license, 21 for poker, 21 for bingo, 18 for bingo without alcohol license, 18 for horse racing, 18 for the California lottery.

Sports Betting in California

Currently there are two up for vote in the November 2022 election that would legalize sports betting.

  • Prop 26: Tribal Sports Wagering Act
    • Would allow tribal casinos and the state’s four horse race tracks to offer in-person sports betting. It would also allow tribal casinos to expand their gambling offerings to roulette and dice games.
  • Prop 27: California Solutions to Homelessness and Mental Health Act
    • Led by FanDuel and DraftKings it would legalize mobile or online sports betting outside of Native American lands, and allow gaming companies to offer online sports betting if they partner with a tribe.
